AN ORDINANCE: TO REGULATE THE PRESENCE OF MINORS UNDER THE AGE OF 18 YEARS ON PUBLIC STREETS AND PUBLIC PLACES DURING CERTAIN PRESCRIBED HOURS
Section 1.
It shall be unlawful for any minor under the age of 16 years to loiter, wander, stroll or play in or upon the public streets, highways, alleys or other public place between the hours of 9:30 p.m. and 6:00 a.m.

Section 2.
It shall be unlawful for any minor under the age of 18 years to loiter, wander, stroll or play in or upon the public streets, highways, alleys or other public place between the hours of 10:00 p.m. and 6:00 a.m.
Section 3.
The provisions of this ordinance shall not apply to a minor accompanied by his or her parent or legal guardian.
Section 4.
DEFINITIONS: For purposes of interpreting this ordinance, the following terms shall be defined as follows:
(a) “Public streets, highways, and alleys”: includes all streets, sidewalks and private ways open to public use.
(b) “Public Place”: means park, playgrounds, school yard, governmental building yards, vacant lots, municipal lots and parking lots open to the public (such as parking lots of stores restaurants, and other places of public accommodation).
(c) “Loiter” means to stand around idly, linger, “hang around”.
(d) “Wander” means to ramble here and there without any certain course; to go idly about.
(e) “Stroll” means to walk about in an idle manner.
(f) “Play” means to engage in recreation or sport, to frolic.
Section 5.
It shall be unlawful for the parents, guardian or adult person having the care and custody of a minor as prescribed in paragraphs one and two of this ordinance to knowingly permit any minor under their care or custody to loiter, wander, stroll or play in or on any public streets or other public places as provided above.
Section 6.
Any minor violating the provisions of this ordinance shall be dealt with in accordance with the laws, regulations and restrictions of the Family Court of Kent.
County, and any parent, guardian, or other adult person with the care and custody of a minor who knowingly violates or permits to be violated the provisions of this ordinance shall, upon conviction by any court of competent jurisdiction, be fined not less than Five ($5.00) Dollars and not more than Twenty-Five ($25.00) Dollars. In lieu of the payment of said fine, shall serve no less than five hours nor more than ten hours of community service as prescribed by the Kenton Town Council or their designate, and each violation thereof shall be considered as a separate offense.
